ORIGINAL HEALTH CERTIFICATE TO BE SENT DIRECTLY TO THE APPLICANT

QUESTION

Dear Mr. Old Man,

I have a case regarding “Copy of  Health Certificate” as follows:

LC requires:

ONE COPY OF HEALTH CERTIFICATE ISSUED BY GOVERNMENTAL AUTHORITY STATING:

(A) THE FISHMEAL WAS PRODUCED IN A PROCESSING PLANTS DEDICATED ONLY TO FISHMEAL PRODUCTION WHERE NO MATERIAL OF ANIMAL ORIGIN OTHER THAN FISH PROTEIN IS BEING USED.

(B) THE FISH MEAL WAS TRANSPORTED IN A MANNER TO AVOID COMMINGLING WITH OTHER ANIMAL PROTEIN

AND ORIGINAL HEALTH CERTIFICATE(S) TO BE SENT DIRECTLY TOKANEMATSU CORPORATION, TOKYO SECTION 

Beneficiary presents a copy of Health Certificate which states as follows:

QUOTE

WE CERTIFY THAT:

(A) THE FISHMEAL WAS PRODUCED IN A PROCESSING PLANTS DEDICATED ONLY TO FISHMEAL PRODUCTION WHERE NO MATERIAL OF ANIMAL ORIGIN OTHER THAN FISH PROTEIN IS BEING USED.

(B) THE FISH MEAL WAS TRANSPORTED IN A MANNER TO AVOID COMMINGLING WITH OTHER ANIMAL PROTEIN.

UNQUOTE

The certificate does not include the certification “AND ORIGINAL HEALTH CERTIFICATE(S) TO BE SENT DIRECTLY TO KANEMATSU CORPORATION, TOKYO SECTION “

Please give me your advice as to whether Health Certificate complies with the LC or not.

In my opinion, Health Certificate complies. Health Certificate issued by Governmental Authority can not certify: “ORIGINAL HEALTH CERTIFICATE(S) TO BE SENT DIRECTLY TO KANEMATSU CORPORATION, TOKYO SECTION” .

I will highly appreciate your opinion.

Hi,

The content of a health certificate would contain information/data about health conditions (and not about the fact that the original health certificate has been sent to the applicant). So, I agree with you that a health certificate issued by governmental authorities would not include such certification.

If the issuing bank intends that the original health certificate is to be sent to the applicant, this requirement should be incorporated into the requirement for presentation of the beneficiary’s certificate, e.g., Beneficiary’s certificate certifying that one original health certificate has been sent directly to the applicant.

I will not raise such a discrepancy.
