Documents presented without the certificate but with B/L bearing the above mentioned content declared by shipper. Is that acceptable? Lam Trang ————– ANSWER Hi Lam Trang, ISBP 745 paragraph A40 provides: “Documents required by a credit are to be presented as SEPARATE DOCUMENTS. However, and as an example, a requirement for an original packing list and an original weight list will also be satisfied by the presentation of two original combined packing and weight lists, provided that such documents state both packing and weight details”. I’m afraid the example in the above paragraph does not appear to apply to your case notwithstanding that such a certification in the bill of lading may have the same effect as in the case where it is stated in a separate certificate issued by the shipping lines. Where a separate certificate issued by the shipping lines is required, it should be presented separately. The fact that the bill of lading contains such a certification does not satisfy the LC requirement, hence, it is not acceptable.
