It is recognized that a Congenbill would bears the heading “Bill of lading to be used with Charter Parties”.

The presentation of a Congenbill bearing a heading as above is considered to be a Charter Party Bill of Lading, hence, it is not acceptable if the presentation of a Charter Party Bill of Lading is not expressly required or is not allowed in the LC.

However, a Congenbill presented without reference to “to be used with Charter Parties” is not considered to be subject to a charter party, and is acceptable.

Back to your case, it is clear that the bill of lading in question is a Charter Party Bill of Lading, the presentation of which is not required or allowed in the LC. Therefore, the correct discrepancy to be raised is “Charter Party Bill of Lading presented I/O Ocean Bill of Lading”.
