It is no doubt that the B/L is discrepant according to UCP 600 Article 20. However, I wonder what if the B/L is pre-printed “shipped on board” or the like. I am a little confused which paragraph of ISBP 745 should be used to check the on board notation? (1) Is the Place of Receipt considered the same as the Port of Loading (Santos vs Santos Port, Brazil)? (2) Is there a means of pre-carriage in this case? If (1) is Yes/No and (2) is No, ISBP 745 paragraph E6 b is applied, no further on board notation is needed. If (1) is No and (2) is Yes then paragraph E6 (c) (i) is applied, a dated on board notation is needed If (2) is Yes, paragraph E6 (c) (ii) is applied, a dated on board notation is needed. Please guide me through this. Thank you TTL ————– ANSWER Hi, I have checked the attached bill of lading and found that it contains neither pre-printed “shipped on board” nor a separate dated on board notation. It contains the wording “RECEIVED in external apparent good order and condition…”, hence, it is a “received for shipment” bill of lading that needs a dated on board notation. You can raise the discrepancy “BL not indicating a dated on board notation”. By the way, here are the on-board notation rules for “received for shipment” bills of lading: If the bill of lading is pre-printed “received for shipment” with or without a place of receipt and no indication of a means of pre-carriage, then a dated on board notation is required. If the bill of lading is pre-printed “received for shipment” with a place of receipt and an indication of a means of pre-carriage or with an indication of a means of pre-carriage only, then a dated on board notation is required with name of the vessel and port of loading. This rule is complying with ISBP 745 paragraph E6. As the bill of lading in question is a “received for shipment” bill of lading with a place of receipt and an indication of a means of carriage, a dated on board notation is required with name of the vessel and port of loading. I think in accordance with Rule # 1, a dated on board notation without name of the vessel and port of loading may also be acceptable in this case because the pre-carriage and the ocean vessel are the same and the place of receipt and the port of loading are the same, too (there is no need for the bill of lading to indicate the pre-carriage which is the same as the ocean vessel).
