Pls be noted that, the B/L not including terms and condition of carriage on its back and on the face of the B/L, we see the phase that “IN ACCEPTING THIS B/L, THE SHIPPER, CONSIGNEE, HOLDER, HEREOF AND THE OWNER OF THE GOODS AGREE, THE SAME AS IF SIGNED BY EACH OF THEM, THAT THE RECEIPT, CUSTODY, CARRIAGE, RELAY, DELIVERY AND ANY TRANSHIPPING OF THE GOODS ARE SUBJECT TO THE TERMS APPEARING ON THE FACE AND BACK HEREOF…”. Whether or not may we consider this b/l make reference to another sourse containing the terms and conditions of carriage base on this phrase? Hope to receive your opinion soon. CAN THE ISUING BANK CITE “LATE PRESENTATION” AS A DISCREPANCY SOLELY BASED ON THE DATE OF THE COVER LETTER?
IS THE NOMINATED BANK REQUIRED TO VERIFY WHETHER THE BENEFICIARY HAS AUTHORIZED THE PRESENTING BANK TO PRESENT THE DOCUMENTS?
