Docs presented : B/L showedPort of discharge: Cai Lan (we know that it is actual port)Place of delivery: Hai Phong Port, VietNam We find that port of discharge is incorrect. Can we raise the discrepancy despite of the Place of delivery is Hai Phong Port, VietNam ? And if the a/m B/L add the sentence"The Goods is unloaded at Hai Phong Port, VietNam", can we treat the B/L is compliance ? Many thanks! ——————-COMMENTN.H.Duc – Viet Nam Posted 05 Mar 10 | Hi, 1. According to article 20 (a) (iii) the bill of lading must appear to indicate shipment from port of loading to the port of discharge stated in the LC. The bill of lading that indicated “Cai Lan” as port of discharge was not in compliance with the terms and conditions of the LC, and is therefore unacceptable. It is a discrepancy. Please refer to R226. 2. Despite the fact the bill of lading stated that the goods are unloaded at Hai Phong port, it is still not complying as the port of discharge indicated in the bill of lading is different from that stated in the LC. CAN THE ISUING BANK CITE “LATE PRESENTATION” AS A DISCREPANCY SOLELY BASED ON THE DATE OF THE COVER LETTER?
