By Mr Old Man Posted on January 3, 2019 2 min read 0 0 2,584 Share on Facebook Share on Twitter Share on Google+ Share on Reddit Share on Pinterest Share on Linkedin Share on Tumblr Đồng lúa Điện Nam Trung QUESTION Dear Mr. Old Man, LC required: Field 46A (amongst other documents): Beneficiary’s certificate along with relevant Courier receipt certifying that one set of photocopied shipping documents plus 1/3 original bill of lading has been sent to the applicant within 5 days after shipment date. Field 47A: “All documents must show contract number and date”. All presented documents including the beneficiary’s certificate showed the contract number and date as required. However, the courier receipt did not. The issuing bank refused the document citing the discrepancy “Courier receipt not indicating contract number and date”. Is the discrepancy raised by the issuing bank valid? Appreciate your soon reply. Best regards, M.M ———– ANSWER Hi, The LC required a courier receipt to accompany the beneficiary’s certificate and form part of the same document required. As the beneficiary’s certificate indicated the contract number and date already, there is no need for the courier receipt to indicate the contract number and date. The discrepancy is not valid for refusal. My answer is based on ICC Opinion R696/TA583rev. Kind regards, Mr. Old Man
IS THE NOMINATED BANK REQUIRED TO VERIFY WHETHER THE BENEFICIARY HAS AUTHORIZED THE PRESENTING BANK TO PRESENT THE DOCUMENTS?
CAN THE ISUING BANK CITE “LATE PRESENTATION” AS A DISCREPANCY SOLELY BASED ON THE DATE OF THE COVER LETTER?
