QUERY FROM DTT

Dear Mr. Old Man,

Could you please do me a favour?

L/C stipulates : PORT OF DISCHARGE: BUSAN, SOUTH KOREA
B/L presented shows : PORT OF DISCHARGE: BUSAN, KOREA

Am I correct if I say the B/L is acceptable?

Looking forward to hearing from you soon.

Regards,

ANSWER

Hi,

You are correct. The described B/L is acceptable. “Busan, Korea” and “Busan, South Korea” are one. No misundertsanding!

What’s more. The B/L is acceptable even if the name “Korea” or “South Korea” is not indicated.
According to ICC Opinion TA708rev, there is no requirement in UCP or international standard banking practice for the country name to appear against a stated city shown as the place of receipt, port of loading, port of discharge … Absence of the country name is not a reason for refusal, notwithstanding that such words are stated in the L/C.

Best regards,
Mr. Old Man

L/C stipulated: Case 1: Available with ABC Bank (Vietnam) by negotiation, Draft at 90 days after transport document AND Case 2: Available with ABC Bank (Vietnam) by negotiation, Draft at 90 days after receipt of complied documents by XYZ Bank (Dubai). Whick one is more risk than? Don't mention payment time. In the case 2, if the documents is lost on journey, will the beneficiary still is paid? Thanks a lot.

Bây giờ bọn em có được phép forward thẳng bộ chứng từ đến issuing bank để đòi tiền hay không? hay phải bắt buộc gửi đến nominated bank kia ạ?Em cảm ơn anh nhiều.

Usance L/Cs issued by banks in Middle East do not follow the common type. The L/C described is acceptance L/C but available with a nominated bank by negotiation of draft at 90 days sight. It should have been issued available with the issuing bank or with a nominated bank by acceptance.I do not think ABC Bank is prepared to negotiate on a without recourse basis unless the draft has been accepted by the issuing bank.I do not think case 1 is riskier than case 2 and vice versus.I think in both cases, the beneficiary is still entitled to payment even when the COMPLYING documents have been lost in transit between the nominated bank and the issuing bank.

Theo Điều 6 (a), L/C quy định xuất trình chứng từ thanh toán tại ngân hàng được chỉ định cũng có thể xuất trình thanh toán tại NHPH. Bạn có thể xuất trình trực tiếp cho NHPH.
