 QUESTION

Dear Mr.  Old Man,

The following LC clause:

44E: Any Australia port

44F: Laem Chabang/Bangkok port Thailand

44B: Bangkok, Thailand

46A: Full set ocean BL consigned to order blank endorsed, marked freight prepaid.

If multimodal BL is presented, the on board notation needs to indicate the port of loading and name of the vessel.

The BL presented indicates:

Pre-carriage by: (empty)

Place of receipt: Melbourne

Port of loading: Melbourne

Ocean vessel: Sky green v.23E

Port of discharge: Bangkok, Thailand

Place of delivery: Bangkok, Thailand

Shipped on board 23.11.23.

Query- Is it required in this case to indicate the port of loading and name of vessel on the on board notation?

My view: The presented documents do not meet the multimodal BL requirement. Therefore, the on board notation does not need to indicate the additional port of loading and vessel name.

ANSWER

Hi Rohini,

It is noted that where an LC indicates any 3 fields from 44A, E, F (or all of them), the appropriate transport document that should be required is Multimodal Bill of Lading.

According to Recommendations of the Banking Commission in respect of the requirements for an On board Notation (Document No.470/1128rev final – 22 April 2010), where a Bill of Lading is pre-printed “Received for Shipment” with or without a place of receipt and NO indication of a means of pre-carriage, a dated on board notation is required and the date appearing in the notation will be deemed the date of shipment. I would like to add: There is no need to indicate the name of the vessel and the port of loading.

The presented Bill of Lading indicates:

Pre-carriage by: (empty)

Place of receipt: Melbourne

Port of loading: Melbourne

Ocean vessel: Sky green v.23E

Port of discharge: Bangkok, Thailand

Place of delivery: Bangkok, Thailand

Shipped on board 23.11.23

The above on board notation is correct. There is no need to indicate the name of the vessel and the port of loading.

For your reference regarding the requirements for an on board notation, please see hereunder the Bill  of Loading Flowchart:

Best regards,

Mr. Old Man
