QUESTION

Dear Mr. Old Man,

Happy new year Mr. Old Man,

Related to Goods covered by more than Bill of lading .

Beneficiary presented Bill of lading with one container “1x40rh” with bill of lading no:SGN0535366” and Bill of lading showed”PART LOAD CONTAINER(S) COVERED BY BLS: SGN053042, SGN0535366

As per E28 ISBP745, Such Bill of lading is acceptable

Please give your idea this case

Hi,

It is recognized that regarding goods covered by more than one bill of lading, paragraph E8 of ISBP 745, which is currently used, is a bit different from paragraph 114 of ISBP 681.

Whereas paragraph 114 says that if a bill of lading states that the goods in a container are covered by that bill of lading plus one or more other bills of lading, and the bill of lading states that all bills of lading must be surrendered, or words of similar effect, this means that ALL BILLS OF LADING RELATED TO THAT CONTAINER MUST BE PRESENTED IN ORDER FOR THE CONTAINER TO BE RELEASED. Such a bill of lading is not acceptable unless ALL THE BILLS OF LADING FORM PART OF THE SAME PRESENTATION UNDER THE SAME CREDIT, paragraph E28 says a bill of lading is not to expressly state that goods covered by that bill of lading will only be released upon its surrender together with one or more other bills of lading, unless all of the referenced bills of lading form part of the same presentation under the same credit.

Notwithstanding the difference of the two paragraphs, I tend to say that the bill of lading in question is not acceptable if all the referenced bills of lading do not form part of the same presentation under the same credit.
