I have one Doubt. L/C shows Field 50 (Applicant) as below: EAST AFRICAN PHARMACEUTICALS PLC ST. ST. SALITMEHERET CHURCH ROAD, NEAR TO JACROSHOUSING COMPOUND ROBERA COFFEE FACTORY TEL: +251116461456/57 TIN 0000034121 Whereas The AWB Clause shows as below: SIGNED AND STAMPED ORIGINAL AIRWAY BILL PLUS ONE COPY MARKED FREIGHT (PREPAID) ISSUED IN THE NAME OF COMMERCIAL BANK OF ETHIOPIA MARKED NOTIFY (APPLICANT EAST AFRICAN PHARMACEUTICALS PLC ADDIS ABABA, ETHIOPIA 0116461456/57). The commercial Invoice presented indicates Applicant as “EAST AFRICAN PHARMACEUTICALS PLC ST. ST. SALITMEHERET CHURCH ROAD, NEAR TO JACROSHOUSING COMPOUND ROBERA COFFEE FACTORY TEL: +251116461456/57 TIN 0000034121”, Whereas the AWB indicates Notify Party as “EAST AFRICAN PHARMACEUTICALS P L C ADDIS ABABA, ETHIOPIA 0116461456/57”. Mike —- ANSWER Dear Mike, According to Article 18(a)(ii) of UCP 600, a commercial invoice must be issued in the name of the applicant. As such, the invoice indicating the applicant as stated in Field 50 is in full compliance with both the letter of credit terms and the referenced article. The Air Waybill indicating the notify party as described also satisfies the requirements outlined in the LC. In my opinion, raising a discrepancy based on ISBP 821 paragraph H15 and UCP 600 Article 14(d) concerning data conflict is not justified. There is no discrepancy! ISBP 821 H15 is not applicable as the credit mentioned the applicant’s name and address details. Zahoor Dattu There is no discrepancy at all. The invoice has been issued in the name of the applicant per the LC requirements. AWB notify is also per the LC requirements. Ilie Bogdan ISBP 821 H15 is not applicable. In our case, the LC clearly indicates an address for the notify party, which is different from the one stated under field 50, which is quite enough common in the LCs. There is no discrepancy at all since the AWB indicates the address stated in the LC.
