QUESTION

Hi,

The bill of lading states that only one of the originals is signed (see attached).

Is the discrepancy valid?

Best regards,

ANSWER

Hi,

I find that the statement itself seems to be conflicting. Unsigned bills of lading are not considered originals. Therefore, if the LC requires 3/3 original bills of lading, presenting only one signed original is not in conformity with the LC. The discrepancy is valid.

However, if 3/3 duly signed original bills of lading are presented as required, there is no discrepancy regardless of that statement.

Note: The above question was discussed by experts on TSU forum and most of the experts have the same opinion as Mr. Old Man.
