Nho anh giai thich dum em mot đieu khoan trong ISBP, para 184 "Consignee information, if shown…., the cert of origin may show applicant of the credit, or another party named therein".
Theo mot so y kien cho rang named therein co nghia la "duoc the hien theo do", neu hieu nhu vay thi "consignee" co the the hien bat cu ben nao, ma neu nhu vay thi quy dinh ve viec the hien applicant co bi thua khong?
Con theo em thi nghi "another party named therein" co nghia la mot ben duoc quy dinh theo L/C.
Xin anh cho em biet cach hieu nao dung.

Chào bạn,
Rắc rối của bạn nằm ở chỗ trạng ngữ “therein” nên được hiểu là (i) in the certificate of origin, hay (ii) in the credit.
Nếu đọc và phân tích kỹ ISBP para. 184 dưới đây, bạn sẽ thấy rằng “therein” được hiểu là “in the credit”.
“Consignee information, if shown, must not be in conflict with the consignee information in the transport document. However, if a credit requires a transport document to be issued "to order", "to the order of shipper", "to order of the issuing bank" or "consigned to the issuing bank", the certificate of origin may show the applicant of the credit, or another party named therein, as consignee. If a credit has been transferred, the name of the first beneficiary as consignee would also be acceptable.”
Nhiều chuyên gia và cá nhân tôi đều cho rằng “another party named therein” nên được hiểu là một bên khác được quy định trong L/C. Trên Diễn đàn DC-Pro tôi đã từng comment một câu hỏi của Raymond (Hong Kong) tương tự như câu hỏi của bạn.
