A L/C REQUIRES A CHINESE C/O FORM A TO BE PRESENTED, BUT WHEN THE DOC IS PRESENTED, IT IS A C/O FORM A BUT STAMPED WITH FORM E . I CHECKED WITH THE CUSTOM AND THEY SAID IT IS THE FACT AND NO PROBLEM. IN YOUR OPINION, IS THIS A DISCREPANCY??? I HIGHLY APPRICIATE YOUR PROMPT ADVICE. SINCERE THANKS,NGUYEN HAI DANG ——————COMMENT Hi As far as I know, certain goods imported from ASEAN countries and China can enjoy special preferential tariff treatment if C/O Form E is presented. Not sure but I think the customs’ explanation is acceptable. It is possible that C/O Form A is issued to comply with L/C requirement but stamped with Form E for the sake of special preferential import duty taxes as per ACFTA (ASEAN – CHINA FREE TRADE AREA). If strictly based on UCP 600 Article 14 (d), the C/O is deemed to be discrepant as the data in the C/O conflict. However, those who check the document with tolerant mind will waive this discrepancy.
